In these Terms and Conditions, Totum Movement (ABN 61 603 934 538) refers to the studio offering services, and you means the person acquiring goods and services from Totum Movement.
These Terms and Conditions may be amended at any time. We will make reasonable effort to inform you of changes, by email, on our website, on social media, and through in-studio signage and announcements.
Acceptance of these Terms and Conditions is a condition of entry. Continued use of our services, or payment of membership fees, is taken as acceptance of these Terms.
Totum Movement complies with the Privacy Act. We take the protection of your personal information seriously. For questions about our Privacy Policy, or to access, correct, or update your details, or to raise a privacy concern, contact info@totummovement.com. Information you provide is stored in our studio management system, Momence; their privacy policy is on their website.
Bookings, passes, and payments
- All purchases are final. Totum Movement does not offer refunds on services or products for change of mind, user error, injury, illness, change of address, or any other reason.
- Passes and memberships are non-transferable.
- Memberships cannot be shared. Class passes may be shared with a partner with prior approval. Both people must accept these Terms, be up to date in our system, and book under their own name.
- You can cancel or reschedule a class through your online account or the app up to 4 hours before your scheduled class time. If you do not attend a booked session, or cancel within the 4-hour window, it is treated as a no-show or late cancel, and you will incur a cancellation fee of 100% or forfeit the booked class.
- Booking into a course or workshop series covers attendance at that series only. Missed classes within a course or workshop are non-refundable and non-transferable to other classes or workshops. Make-up classes are not standard and are subject to availability.
- If you cannot attend a booked class, please cancel so your place can be offered to someone else.
Your belongings
If you bring personal items into the studio, Totum Movement is not responsible for their safekeeping while you attend class. Cubby boxes are provided inside the studio.
Assumption of risk
In voluntarily attending classes at Totum Movement, you understand that you are undertaking exercise and training that may involve stretching, movement, weightlifting, gymnastic movements, strenuous bodyweight exercises, and other high-exertion activities, all of which carry inherent risk of injury.
You acknowledge that there are inherent risks in all aspects of physical training, and that you have been informed of the possible strenuous nature of the training and the potential for undesirable physiological results including, but not limited to, abnormal blood pressure, muscle soreness, fainting, heart attack, and death.
You understand that in a group class setting, not everyone's individual requirements can be accommodated. You are not obligated to perform or participate in any activity you do not wish to do, and you may decline at any time. Totum Movement encourages you to ask questions and to seek alternative movement or training options at any time.
You acknowledge that teachers may use tactile cueing and adjustments to maintain a safe practice and to deepen your learning. If you do not want tactile cueing, for any reason, please tell the instructor.
You warrant that you do not suffer from any medical condition that may affect your ability to participate safely in strenuous exercise. You give Totum Movement and its staff permission to seek emergency medical services for you should you become injured or ill, on the understanding that you are responsible for any expenses incurred. If you are signing on behalf of a minor, you give permission for any person connected with the studio to administer first aid as needed, and, in the case of serious illness or injury, to call for medical or surgical care and to transport the child to a medical facility deemed necessary for their wellbeing.
Release and indemnity
You agree to waive any and all claims that you have or may have in the future against Totum Movement and its directors, officers, employees, agents, volunteers, and independent contractors (collectively, the Releasees). You agree to release the Releasees from any and all liability for any loss, damage, injury, or expense that you or your next of kin may suffer as a result of your participation in the programs, activities, and services provided by or at Totum Movement, due to any cause whatsoever.
You agree to hold harmless and indemnify the Releasees from any and all liability for any damage to the property of, or personal injury to, any third party resulting from your participation in any program, activity, or service.
This agreement is binding on you, your successors, representatives, heirs, executors, assigns, and transferees. If any portion of this agreement is held invalid, the remainder remains in full legal force and effect.
Changes, fees, and media
Every effort is made to deliver classes and services as advertised. However, the schedule is subject to change, and Totum Movement is not liable to refund or offer compensation of any kind for classes that are changed or cancelled for any reason.
We reserve the right to increase fees for classes, passes, or memberships at any time.
Totum Movement may take photos and film during classes. This footage may be used for marketing, social media, and online materials. If you do not wish your image to be used in this way, email info@totummovement.com.
